End User Software License Agreement / Boutros Arabic Fonts CDBOUTROS ART MediumSOFTWARE LICENSE AGREEMENTThis Software License Agreement is your proof of license. Please treat it as valuable property.This is a legal agreement between you, the end-user (Licensee), and Boutros International (BOUTROS).READ THE FOLLOWING AGREEMENT CAREFULLY. BY USING THE FILES ON THIS CD-ROM YOU INDICATE THAT YOU HAVE READ THIS AGREEMENT AND ACCEPT ITS TERMS.IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, RETURN THE CD-ROM WITHIN SEVEN (7) DAYS OF RECEIPT TO (ART) OR TO THE SUPPLIER WHOM YOU PURCHASED IT FROM.1. Grant of License. BOUTROS grants you a non-exclusive license to use the computer software contained on the CD-ROM (Software) on not more than three (3) computers at a time with no more than one (1) attached printer. BOUTROS reserves all rights not expressly granted by this Agreement. Use of the Software on more than three (3) computers or installation of the Software on a network server is not permitted by this license and requires a separate multi-user license from BOUTROS.Portions of the Software may be licensed by various suppliers to BOUTROS with rights to sublicense. BOUTROS is a trademark of Boutros International and this Software License Agreement or use of the Software does not grant you any license, right or interest in such trademark.2. Title and Copyright. Title to and ownership in the Software, including to those portions that may be licensed to BOUTROS by its suppliers, does not pass to you under this Software License Agreement and is retained by BOUTROS and its suppliers. The Software is protected by international copyright laws, international treaty provisions, and all other applicable national laws. You agree not to duplicate or copy the Software, any portion thereof, or any accompanying written materials. You may, however, transfer the Software to the hard disk of not more than three (3) computers (other than a network server) provided that all of the original proprietary notices remain intact.3. Other Restrictions. You may not distribute, sell, sublicense, rent, lease or otherwise transfer the Software except, however, you may transfer your rights under this Software License Agreement on a permanent basis, provided you transfer all copies of the Software, including all updates and prior versions, if any, and all accompanying written material, and the recipient agrees to the terms of this Agreement. You agree not to modify, reverse engineer, decompile or disassemble the Software.4. Termination. This License and your right to use the Software automatically terminate without notice if you fail to comply with any provision of this Agreement. Upon termination, and as requested by BOUTROS, you will either return to BOUTROS or destroy the Software and accompanying written materials.5. Limited Warranty. BOUTROS warrants, to the original Licensee only, for a period of ninety (90) days after the date of purchase and in the absence of accident, abuse or misapplication, that the media will be free from defects in materials and workmanship under normal use and service.BOUTROS does not warrant that use of the Software will be uninterrupted or error-free. Any implied warranties on the Software and CD-ROM are limited to ninety (90) days in states which prohibit the disclaimer of implied warranties. BOUTROS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO SOFTWARE, WRITTEN MATERIALS AND CD-ROMS, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.6. Customer Remedies. BOUTROS's entire liability to you in connection with the Software and your exclusive remedy for breach of warranty shall be: repair or replacement of the Software or the CD-ROMS which are returned to BOUTROS with a proof of purchase. Any replacement Software or CD-ROMS will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. IN NO EVENT SHALL BOUTROS OR ITS SUPPLIERS BE LIABLE FOR ANY OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, WRITTEN MATERIALS OR DISKETTES OR CD-ROMS, EVEN IF BOUTROS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. No change to this Agreement is effective unless made in writing and signed by authorised representatives of both parties. No BOUTROS dealer, distributor, or agent is authorised to make any modification or addition to this warranty.7. United States Government Restricted Rights. The following paragraph only concerns sales to a United States Government Department, Agency, Embassy, Consulate, or Instrumentality . Otherwise, it is NOT APPLICABLE. The Software and written materials are provided with RESTRICTED RIGHTS. Use, duplication or disclosure by the United States Government, its agencies and/or instrumentalities (the Government) is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights clause at 48 CFR 52.227-19, as applicable.
